A fair charge for a car accident attorney is one-third or 33.33% of the total recovered amount.

Contingency Fees. The usual and customary attorney fees for a car accident attorney to take on a personal injury car wreck claim has always been one-third percent (33.33%) of the recovery with forty percent (40%) upon filing a lawsuit in court.

When attorneys charge a higher amount for a simple car accident case it is not fair. Many factory type law firms are now trying to charge forty percent (40%) at the start of a case and increase to forty-five percent (45%) and even fifty percent (50%) or higher.

Expenses. Expenses are monetary costs that your lawyer advances to help build your case. These include copy costs, medical records and bills, accident reports and photos, investigators, accident reconstruction experts, economic loss experts, filing fees, deposition costs and other related case development costs.

The important thing for the car accident person to know is that they should ask if the lawyer loses their case, do they expect to be paid back even when case is lost. Fair personal injury car wreck attorneys do not ask for their expenses to be reimbursed unless they win.

Settlement or Trial. Attorney fees are usually higher when a case is filed in a court of law because courts require a filing fee and the amount of work for the lawyer is much more extensive when your car accident injury case must be filed in trial. Pleading and discovery have to be undertaken. Depositions are usually taken, and experts may be necessary on a particular case.
